Indefinite Leave to Remain (ILR) through the Ten Years Long Residence route is a pathway to permanent settlement in the UK for certain long-term migrants. It allows individuals who have continuously lived in the UK for a period of ten years to apply for settlement, granting them the right to live and work in the UK without any immigration restrictions.
To be eligible for ILR under the Ten Years Long Residence route, applicants must meet the following key criteria:
- Continuous Residence: The applicant must have continuously resided in the UK for ten years, with absences not exceeding a certain total number of days.
- Lawful Residence: The residency must be legal, and the applicant should have maintained valid visas or leave to remain during the entire ten-year period.
- Absence Threshold: The applicant must not have spent more than 540 days (18 months) outside the UK during the ten-year period.
- Good Character: The applicant should demonstrate good character, with no criminal convictions or serious breaches of immigration laws.
- English Language Requirement: Most applicants will need to meet the English language requirement, proving their proficiency in English.
- Life in the UK Test: Applicants will generally need to pass the Life in the UK test, which assesses their knowledge of British customs, traditions, and history.
Once granted, ILR provides individuals with the ability to live and work in the UK indefinitely. After holding ILR for a specified period (usually one year or longer), individuals may become eligible to apply for British citizenship if they meet the additional requirements.
